State Commercial Tax Credit

Developers often use the Tax Credit Incentive program to help finance large rehabilitation projects like the Jefferson Hotel in Caddo Parish. The Tax Act staff is available to assist with projects throughout the state. This building in Opelousas was successfully rehabilitated using the State Commercial Tax Credit Program. It is now an excellent addition to the downtown. View the interior before and after photos of this State Tax Credit project in Opelousas. This residence on Royal Street in New Orleans was successfully rehabilitated using the Residential Tax Credit Program. Use of the Tax Credit Incentive Program is not limited only to developers and large commercial buildings. This New Orleans house, now a bed and breakfast, is a recent example of the program at work.

To be eligible for the 25% Tax Credit:

  1. The building must be a contributing element to a Downtown Development District (DDD) or a Cultural District.
  2. The building must be used for an income-producing purpose.
  3. Eligible expenses must exceed $10,000
  4. No taxpayer or entity affiliated with that taxpayer may receive more than $5 million in credits for rehabilitation work within a particular DDD.
  5. Rehabilitation must meet the Secretary of the Interior’s Standards for Rehabilitation.
  6. Any unused credit may be carried forward for up to five years.
  7. The credit may be sold to a third party under certain circumstances. Applicants are advised to consult their tax professional in this case.

The Application Process

The application is a three part process. Each part requires approval or “certification” by the Division of Historic Preservation.

Part 1:
Documents the building as a certified historic structure and one that is eligible to receive the tax credit.
Part 2:
Describes the proposed rehabilitation project. This should include all work items on which money is being spent.
Part 3:
A Request for Certification of Completed Work, documents that the work was completed according to Standards.

Applications are available upon request from the Division of Historic Preservation. To request a copy click here. If you plan to download the application information, it is highly suggested that you download all of the information that is indicated by the asterisks(*).

For Federal and State Applicants:
When applying for both programs, applicants should submit to DHP a complete Federal application in duplicate and only the cover sheet of each Part of the State application (property information and owner information). All Federal and state forms must be signed and dated.
